New legislation regarding swimming pools in NSW will come into practice from 29 April 2016. The changes mean any property in NSW with a pool or spa cannot be sold or leased without a valid certificate of compliance or relevant occupation certificate, from the Fair Trading website here.
In regards to leasing a property with a spa or swimming pool:
Any property leased after 29 April 2016 must have a swimming pool certificate of compliance or relevant occupation certificate. A copy of this certificate must be supplied to the tenant.
In regards to selling a property with a spa or swimming pool:
Any property being sold after 29 April 2016 must have in the contract for sale of land a valid certificate of compliance or relevant occupation certificate and this must have been issued within the last three years. The contract must also have a certificate of registration of the swimming pool or spa.
